The Punjab and Haryana High Court has opined that a homebuyer can pursue remedies under the Real Estate(Regulation and Development) Act, 2016 as well as the Consumer Protection Act simultaneously. A division bench of the High Court held that it is not mandatory that a person, whose complaint is pending before the Consumer Commission, should need to have it transferred to the RERA.

A Supreme Court bench headed by Hon’ble Mr. Justice R. F. Nariman and comprising of Justices Navin Sinha and KM Joseph has reiterated the legal position that all stay orders on civil or criminal proceedings passed by courts including High Courts would stand to automatically expire after six months unless such order is extended within the said period for some good reason.

The Supreme Court has held in a new judgment that a wife is also entitled to claim a residence right in a shared household belonging to relatives of the husband. The new judgment overrules the 2006 judgment in S.R. Batra vs Taruna Batra.
