The Calcutta High Court, while adjudicating upon a plea wherein the arbitration was before ICC, held that, unless expressly excluded by parties to the arbitration, choosing a foreign law to govern an arbitration would not exclude the provision of approaching Indian courts for interim relief under Section 9 of the Arbitration and Conciliation Act, 1996.
